KWIKA.co.za - Terms and Conditions
The KWIKA.co.za Directory Services enable users and consumers to search for, to find, and to engage with service providers (sometimes referred to as ‘tenants’) represented on our search directory and by accepting these Terms and Conditions, the user acknowledges and agrees that there are risks associated with using the services of an online marketplace when engaging with other users, suppliers and service providers who utilise the KWIKA.co.za platform to promote their goods and services to the KWIKA.co.za platform community.
Any services procured through the use of the KWIKA.co.za platform do not constitute any binding agreement between those parties and KWIKA.co.za. Any agreements whether written, proposed, consensual or implied, via whichever medium, will explicitly exclude any liability on KWIKA.co.za.
Any services procured through the advertising medium provided on KWIKA.co.za do under no circumstance constitute or infer or imply any agreement between any of those parties and KWIKA.co.za as a broker. KWIKA.co.za is a directory service provider and in terms an agent but not a broker or party to any agreement between the relevant service providers and their user or consumer.
By utilising the KWIKA.co.za services and accepting our terms and conditions, users acknowledge that KWIKA.co.za will never assume the role of supplier of any of the solutions or services advertised by our service providers (the ‘tenants’), the advertisers or their respective proxies.
KWIKA.co.za will endeavour to provide accurate and up to date information on our platform subject to the understanding that by nature of the business of the medium, KWIKA.co.za is totally reliant on service providers and/or third parties, or their proxies, to furnish accurate information to KWIKA.co.za. KWIKA.co.za will not be liable for any act and or omission by a Tenant and or its Agent. Through moderation and considered advice from the relevant service provider/s, KWIKA.co.za will endeavour to correct, edit, change, omit or delete any information deemed to be inaccurate, offensive or inappropriate. In this sense KWIKA.co.za will not be held liable under any circumstances for error, omissions or inaccuracies that may be published on our platform.
For the User/Consumer, by accessing the KWIKA.co.za services, such user/consumer accepts our terms and conditions of use as set out and indemnifies KWIKA.co.za of any liability for conceivable losses incurred.
Whilst KWIKA.co.za will take all reasonable precautions to ensure the integrity and reasonable stability of our website and its contents, no warranty, whether expressed or implied, is given that the website will operate error-free. KWIKA.co.za will further offer no guarantees against electronic viruses, trojans or any other data or harmful codes that may have the ability to affect or corrupt the users’ browsing platform. Matters of this nature are often outside of our control and are intrinsic to public domains.
KWIKA.co.za shall not be held liable for any direct or indirect damages or losses incurred as a result of any unavailability, incorrect, inaccurate or omitted information in the event that KWIKA.co.za platform may for whatever reason become temporarily unavailable or offline.
KWIKA.co.za reserves the right to make any changes or alterations to our website, as well as discontinue or alter any aspect, its content or the services offered at any time and without prior notice to the user. No such changes, modifications, temporary offline or discontinuance shall entitle the user or advertiser (tenant) to any compensation or hold KWIKA.co.za to any liability whatsoever.
Ordinary use of KWIKA.co.za is free of charge, however, certain categories of advertising are subject to fees payable.
KWIKA.co.za and its authors (60PLUS + Media) own the intellectual property rights pertaining to this service and material in provision of this service medium. All intellectual property rights are reserved and proprietary to the authors. A user may view, download for caching purposes, and print pages for own use subject to internationally accepted copyright laws.
Advertisers providing KWIKA.co.za with intellectual property rights or content and causing such to be published using our services, the advertiser grant KWIKA.co.za non-exclusive, royalty-free, perpetual and irrevocable licence to perform on any and all relevant copyright, trademark and intellectual property rights to be captured, stored and retained in our database engines and entitle KWIKA.co.za to host, cache, route, transmit, copy, reproduce, publish and distribute such intellectual property through various public media, including but not limited to the internet, as reasonably permitted under applicable law, on the proviso that such information is supplied under the banner of KWIKA.co.za branding.
